Buying a home in California is about to look a little different in 2026. New housing laws are creating more options, stronger safety standards, and smoother approval processes for buyers across the state — especially in the Bay Area.


Here are the key changes you should know before making your next move.


1. SB 79 – More Homes Near Transit


The Abundant and Affordable Homes Near Transit Act allows higher-density housing within half a mile of major public transit stops like BART, Caltrain, and ferry terminals.


Why it matters: Buyers will have more opportunities to find modern, walkable homes close to work, transit, and amenities.


2. AB 1455 – Wildfire Safety Zones


California will introduce “Zone 0” ember-resistant buffers within 5 feet of homes in fire-prone areas. These new defensible space standards take effect immediately for new homes and within three years for existing ones.


Why it matters: Buyers should confirm compliance before purchasing in wildfire-risk regions — it can affect both safety and insurance rates.


3. AB 253 – Faster Building Permits


If a city or county delays plan reviews beyond 30 days, you can now use a private reviewer to expedite the process.


Why it matters: Perfect for Bay Area buyers planning remodels or new construction — less waiting, faster results.


4. AB 493 – Interest on Insurance Proceeds


Lenders must now pay 2% annual interest on any insurance funds they hold after a claim.


Why it matters: It protects homeowners from unnecessary delays after a loss or disaster.


5. AB 226 & AB 525 – FAIR Plan Updates


California’s FAIR Plan will receive additional funding to stabilize fire insurance coverage — including for manufactured and mobile homes.


Why it matters: Insuring your new home, even in higher-risk areas, is becoming easier and more reliable.
